By placing an order with DZigns, you confirm that you are in agreement with and bound by the terms and conditions below.
Definitions: The Client : The company or individual requesting the services from DZigns. DZigns: The main designer/site owner
General
Vanessa Richardson from DZigns will carry out work only where an agreement is provided either by email, telephone or mail and will carry out work only for clients who are 18 years of age or above. An 'order' is deemed to be a written or verbal contract between DZigns and the client, this includes telephone and email agreements.
Website Set Up & Design
Whilst every endeavour will be made to ensure that the website and any scripts or programs are free of errors and done correct and to search engine friendly specifications, DZigns cannot accept responsibility for any losses incurred due to malfunction of the website or any part of it. The website, graphics and any programming code remain the property of Dzigns & CabanovaXL or Mochahost until all outstanding accounts are paid in full. DZigns cannot take responsibility for any copyright infringements caused by materials submitted by the client. We reserve the right to refuse any material of a copyrighted nature unless adequate proof is given of permission to use such material. The client agrees to make available as soon as is reasonably possible to DZigns all materials required to complete the site to the agreed standard and within the set deadline. DZigns will not be liable for costs incurred, compensation or loss of earnings due to the failure to meet agreed deadlines, or due to the client experiencing difficulties or disputes regarding any domains, hosting or any other service the client might have purchased, assosiated with the website being created by Dzigns. DZigns will not be liable or become involved in any disputes between the site owner and their clients and cannot be held responsible for any wrongdoing on the part of a site owner. e.g. Any disputes re content/images that have been provided to us for inclusion on the site. DZigns will not be liable for any costs incurred, compensation or loss of earnings due to the unavailability of the site or its servers, should it become temporarily unavailable due to internal errors or maintenance.
Site Creation Period, Domain Transfer & Hosting & Issues
NB: Please note that there is A Time Limit Attached to Each Package as to How Much Time is Spent Designing it & publishing it to the web. After receipt of a deposit from the client, Dzigns will register the hosting & domains and start work on the site. If the client has already purchased a domain, Dzigns will transfer it to their Hosting company and domain registrar within 7 working days. DZigns will not be liable for any costs incurred, compensation or loss of earnings due to any delays, problems or issues the client may have regarding their domain they purchased & registerred and it's registrar during the transfer of domains process. The domain transfer process may take up to 2 weeks in some cases if queries arise during this time that need dealing with. If Dzigns have to undertake extra work (Spending a lot of additional time & resources) relating to the transfer process and deal with issues relating to this (domains registered by client & being transferred by Dzigns), then Dzigns reserve the right to charge an extra fee for their time & Resources. Any extra time and resources Dzigns invest which is above the inclusive service Dzigns deliver which is included in the package the client chose, will be charged at an extra cost. All information needed to build the site must be submitted from the client to Dzigns within a maximum of 10 working days, after the deposit was paid. All websites will be done to the Highest standard in our allotted time and Dzigns will get you online within a Maximum of 2 weeks AFTER 1) Deposit is Paid, 2) the domain transfer & regsitration is complete, 3)and all the information is received from the client to complete the site and the rest of full payment is received and cleared. Any delays on the client's side in providing the information needed to create the site, will cause a delay and will incur extra cost to the client.
PAYMENT
A deposit of 50% is required with any standard project. The remaining 50% is payable prior to website being published. (For cheques, a 5 working day clearance period is needed for funds to clear) There are no exceptions to this, i.e. If the client decides they no longer want the site, as they have commissioned the work and paid a deposit they are still obliged to pay for the work that has been done. Non-payment will result in legal action being taken if necessary. Deposits are also non-refundable. No work will be undertaken until full deposit is paid. PAYMENT METHODS:We accept Bank Guaranteed Cheques, Postal Orders, Direct Payment into our Bank Account or Online Payment Requests by Credit or Debit Card through PAYPAL.
Functionality
DZigns will endeavour to ensure that any designed site will function correctly on the server it is installed in and that it will function correctly and to an acceptable level when viewed with web browsing software on all browsers. DZigns can offer no guarantees of correct function with all browser software.
DZigns uses CabanovaXL , Mochahost & 1Freecart to host & Create our websites & Online Stores and no guarantees can be made as to the availability or interruption of this service. DZigns cannot accept liability for losses caused by the unavailability, malfunction or interruption of this service, or for loss of turnover, sales, revenue, profits or indirect, consequential or special loss. Dzigns also use An Affiliate to manage Website Promotion, Optimisation and marketing and cannot accept liability for losses caused by the unavailability, malfunction or interruption of this service, or for loss of turnover, sales, revenue, profits or indirect, consequential or special loss. DZigns reserve the right to refuse to handle in any way, material which may be deemed offensive, illegal or in any way controversial, and also to terminate the hosting service should the necessity arise.
Payment of Accounts
A 50% deposit is required from any new client before any work is carried out. It is the DZigns policy that any outstanding accounts for work carried out by DZigns or its affiliates are required to be paid in full prior to publishing websites. We will contact clients via email and telephone to remind them of such payments if they are not received when due. If accounts are not settled or DZigns have not been contacted regarding the delay, access to the related website may be denied and web pages removed, we will then pass such cases to the Small Claims Court to pursue payment.
Complaints Procedure
Anyone who experiences a problem with their web service provided by DZigns should raise the matter directly by phoning us straight away or using our online contact form to do so, giving sufficient information to locate the material (such as an url) and clearly outlining the grounds for complaint. DZigns will then resolve the matter to the satisfaction of the complainant as soon as possible. You may also write to the address above.
PRIVACY POLICY
It is Dzigns Policy NOT TO SHARE any of our clients Personal Information with any third party or other companies other than our affiliate companies whom host & provide the domains or web space or website promotion in question and whom require some of the client's details for obvious reasons. All clients are Protected under the Data Protection Act by LAW.
